The First Instance Disciplinary Commission for Prosecutors of the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC B&H / Council), deciding on the disciplinary lawsuit of the Office of the Disciplinary Prosecutor (UDT) of the HJPC B&H against the defendant Gordana Tadić, Chief Prosecutor of the Prosecutor's Office of Bosnia and Herzegovina, the disciplinary responsibility of the defendant for disciplinary offenses is determined, acting contrary to Article 5.2. Code of Ethics for Prosecutors, which prescribes that the prosecutor will dedicate his professional activity to his duties, which include not only performing the prosecutorial function, but also other tasks relevant to the prosecutor's office, thus showing negligence and committing a disciplinary offense under Article 57, item 8. negligence in the performance of official duties ”and item 17“ failure, for unjustified reasons, to act in accordance with the decisions, orders or requests of the Council ”of the Law on the HJPC B&H.
Pursuant to the provisions of Article 58, Paragraph 1, Item (e) and Article 59 of the Law on the HJPC of B&H, the defendant is subject to disciplinary measures: Transfer from the position of Chief Prosecutor of the Prosecutor's Office of Bosnia and Herzegovina to the position of Prosecutor of the Prosecutor's Office of Bosnia and Herzegovina.
An appeal against this decision may be lodged with the Second Instance Disciplinary Commission of the HJPC B&H within 8 days from the day of receipt of the decision.
